Nicole Oliva
Founder and Mediator
Meet Nicole Oliva
A San Diego Mediator with Real Training, Real Experience, and Lived Perspective
Before founding Common Ground Mediation, Nicole Oliva worked as a federal EEO investigator handling high-conflict workplace disputes, discrimination claims, and sensitive interpersonal matters where neutrality and structure were non-negotiable. That background gave her something most mediators simply do not have: disciplined, professional-grade experience managing emotionally charged situations before she ever sat down at a mediation table.
Nicole holds dual Master's degrees from Pepperdine University: a Master of Dispute Resolution from the Straus Institute for Dispute Resolution, one of the most respected conflict resolution programs in the United States, and a Master of Legal Studies from the Caruso School of Law. She brings that formal training into every session alongside a deep understanding of the San Diego community and the modern families she serves here.
Nicole has personally navigated marriage, divorce, remarriage, fertility treatment, and modern family transitions. She knows what it feels like to manage shared finances, embryos, and parenting responsibilities without a clear legal roadmap. That understanding shapes every conversation she has with clients across San Diego and Southern California.
Dual Master's Degrees from Pepperdine University
Nicole holds an MDR from the Straus Institute for Dispute Resolution, with focused training in mediation, negotiation, high-conflict communication, and the psychology of conflict. She also holds an MLS from the Caruso School of Law, covering legal reasoning, critical analysis, and navigating the US legal system responsibly and ethically.
Former Federal EEO Investigator
Prior to launching her San Diego mediation practice, Nicole served as a federal EEO investigator managing sensitive workplace matters including discrimination allegations, communication breakdowns, and high-conflict interpersonal disputes. That role trained her to stay neutral under pressure, document issues with precision, and move complex situations toward resolution.
Lived Experience in Modern Family and Fertility Transitions
Nicole has personally lived through marriage, divorce, remarriage, IVF treatment, and blended family life. This firsthand experience gives her a depth of empathy and contextual awareness that formal training alone cannot provide. San Diego clients consistently describe feeling understood at a level that goes beyond what they expected from a professional mediator.
Deeply Rooted in the San Diego LGBT Community
Nicole is personally and professionally connected to the LGBT community in San Diego and North County. She understands the specific legal gaps, structural challenges, and emotional complexities that LGBT couples and non-traditional families face during separation, asset division, parenting transitions, and fertility-related decisions.

Mediation in San Diego Can Help with More Than You Think
Most people assume mediation is only for divorce. Many San Diego couples and families are relieved to discover that some of their most difficult and personal situations have a structured, private path forward completely outside of court.
Pet Custody Mediation
Deciding who keeps a shared pet during a separation is more emotionally complicated than most people anticipate. Mediation gives San Diego couples a calm, structured process for reaching a fair agreement that accounts for the real bond both parties share with their animal. Court proceedings rarely handle this kind of conversation with the care it deserves.
Embryo and Fertility Decision Mediation
Couples who have gone through IVF often face difficult decisions about frozen embryos when a relationship ends. Mediation provides a private, neutral space for those conversations to happen thoughtfully and on your own terms, before they escalate into legal disputes that are far more costly and painful to navigate.
Non-Married Couple Separation
Long-term partners in San Diego who were never legally married often share homes, finances, businesses, and parenting responsibilities that still need to be formally addressed during a separation. Mediation creates a structured, fair process for untangling a shared life even when no standard legal framework applies to the situation.
Shared Asset and Property Mediation
Separating couples frequently share far more than a marriage certificate. Real estate, bank accounts, furniture, investments, and business assets all need to be addressed. Mediation gives San Diego couples a collaborative, structured process for dividing shared assets fairly without the expense and adversarial dynamic of going to court.
Our Specialty
San Diego Mediation for Modern Couples, Families, and Individuals
Common Ground Mediation was built specifically for the modern couples and families of San Diego and Southern California. People who want a calmer, more collaborative, and emotionally intelligent alternative to traditional conflict resolution. Whether your situation fits neatly into a legal category or not, there is a structured path forward here.
LGBT Couples and Non-Traditional Partners in San Diego
Common Ground Mediation was built with San Diego's LGBT community in mind. Nicole understands the unique legal gaps, structural challenges, and emotional dynamics that these relationships involve, particularly when navigating separation, shared asset division, or parenting transitions that fall outside conventional legal frameworks.
Couples in San Diego Navigating IVF and Fertility-Related Stress
Fertility treatment introduces a specific set of decisions and emotional pressures that most conflict resolution processes are not designed to handle. This practice combines formal mediation training with personal IVF experience, making it one of the few spaces in San Diego where these conversations can happen with genuine structural support and real human understanding.
Co-Parents Building Long-Term Agreements for Their Children
Effective co-parenting in San Diego requires more than a custody document. It requires a communication structure that holds up over time. Mediation helps co-parents build parenting plans that are practical, child-centered, and flexible enough to evolve as children grow and family circumstances naturally change.
Long-Term Partners Separating Without a Legal Marriage Structure
Many San Diego couples share homes, finances, pets, children, and businesses without ever being legally married. Mediation provides a fair, structured process for navigating that kind of separation when no standard legal roadmap exists and there is a lot of shared life that needs to be addressed thoughtfully.
Anyone in San Diego Who Values Privacy and Emotionally Aware Support
Mediation is a confidential process that keeps difficult conversations entirely out of courtrooms and public records. For San Diego residents who value discretion, scheduling flexibility, and a process that respects their emotional bandwidth, Common Ground Mediation offers something the traditional legal system is simply not designed to provide.
Millennial San Diego Couples Who Want a Modern, Respectful Process
Many millennial couples in San Diego are looking for a conflict resolution process that feels collaborative, efficient, and human rather than adversarial. Common Ground Mediation is designed to be exactly that, with virtual sessions available statewide, clear pricing, and a process built to move forward without unnecessary escalation or delay.
How It Works
The San Diego Mediation Process at Common Ground: A Structured Path Forward
Mediation does not have to feel overwhelming or confusing. Here is what working with Common Ground Mediation typically looks like, from the first conversation all the way through to a final agreement both parties can move forward with confidently.
1
Free Consultation
A free, no-pressure conversation where Nicole takes time to understand your situation, answer your questions honestly, and determine whether mediation is the right fit for you. There is no retainer required and no obligation to continue. This step exists so you can make an informed decision before anything else moves forward.
II
Intake and Preparation
Once both parties agree to proceed, secure intake forms and relevant documents are shared through a private client portal. A preparation session is also scheduled to ensure each party feels organized, informed, and ready before formal mediation begins. This reduces friction and makes the overall process more efficient and focused from the start.
III
Mediation Sessions
Structured sessions conducted virtually via Zoom or in person at a San Diego location, depending on your situation and comfort level. Both parties have equal space to be heard, issues are addressed methodically, and sessions are paced to maintain momentum while giving each topic the care and attention it genuinely deserves.
IV
Agreement & Closure
A clear, practical written agreement that reflects both parties' needs, priorities, and long-term goals. Drafted with care and designed to hold up well after mediation ends, the agreement can also be coordinated with attorneys or other professionals in San Diego when needed to support the finalization process.
Nicole was the first person who made us feel like we could actually slow down and work through things instead of just fighting about them. She didn't talk over us or make us feel stupid for not understanding the process. She took the time to explain things in a way that actually made sense, helped us break overwhelming issues into smaller pieces, and made us feel more involved and empowered in the decisions we were making instead of feeling pushed into them.
What stood out most was that she genuinely cared about helping us create solutions that worked for our real life, not just what looked good on paper. The process felt calm, private, structured, and human during one of the hardest periods of our lives.”

Common Questions
Is Mediation in San Diego Right for You?
Many people come to Common Ground Mediation unsure whether it applies to their specific situation. These are the questions San Diego clients ask most often before getting started.
What is mediation and how is it different from going to court in California?
Mediation is a private, structured process where a neutral third party helps both parties communicate more effectively, work through key issues, and reach a mutually agreeable resolution without a judge making decisions for them. Unlike litigation in California courts, mediation keeps control in the hands of the people directly involved. It is typically faster, far less expensive, and significantly less adversarial than going to court.
Do both parties have to agree to participate in mediation?
Yes. Mediation is a voluntary process and works best when both parties are willing to participate in good faith. It is designed for people who are open to communication and focused on finding workable solutions rather than winning. If one party is not willing to engage constructively, Nicole will tell you honestly whether mediation is still a viable option for your situation.
We are not married. Can mediation still help us in San Diego?
Absolutely. Many of the couples and families Common Ground Mediation serves are not legally married. Long-term partners who share homes, finances, pets, businesses, children, or other assets are all welcome here. The mediation process does not require a marriage certificate to be useful, legally significant, or worth pursuing.
What if our conflict feels too emotional or too high-stakes for mediation?
High emotion is not a reason to avoid mediation. In many cases it is precisely why mediation works better than litigation. Nicole's background managing high-conflict EEO investigations means she is professionally trained to navigate emotionally charged conversations with structure, neutrality, and care. Sessions can be paced, adjusted, and restructured to meet the specific needs of each situation.
Do you work with LGBT couples and non-traditional families in San Diego?
Yes, and this is one of the core areas of specialization at Common Ground Mediation. Nicole is personally and professionally connected to San Diego's LGBT community and understands the specific dynamics, legal gaps, and emotional complexity these relationships involve. You will not need to over-explain your situation or feel like a case study here.
How much does mediation cost in San Diego?
Common Ground Mediation offers tiered and custom-quoted packages based on the scope and complexity of each situation. There is no retainer required to begin, and a free initial consultation is available so you can understand your options before committing to anything. Mediation is almost always significantly less expensive, financially and emotionally, than litigation through the California court system.
