Common Ground Mediation, LLC (“Common Ground,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect through https://findcommongroundmediation.com (the “Site”), how we use and share it, and the choices you have. By using the Site, you agree to the practices described here.

Our practice is based in North County San Diego, California, and we serve clients in person in San Diego and virtually throughout California. If you do not agree with this policy, please do not use the Site.

1. Information We Collect

  • Your name, email address, and phone number
  • The subject of your inquiry and the service you are interested in
  • A description of your situation, which may include details about your relationships, family, finances, workplace, or other personal circumstances
  • Documents or information you share after you become a client

  • IP address, browser type, device type, and operating system
  • Pages viewed, links clicked, time spent on the Site, and the website that referred you
  • Information gathered through cookies and similar technologies (see Section 5)

Please keep website messages brief. Please do not include highly sensitive details, such as medical records, financial account numbers, Social Security numbers, or specifics of any safety concern, in website forms or general emails. We will tell you how to share that information securely once we have spoken.

2. Sensitive Information

Because of the nature of our services, what you tell us may reveal sensitive personal information, such as details about your family, relationship status, sexual orientation or gender identity, reproductive or fertility matters, health, or finances. We use this information only to respond to your inquiry, assess whether our services are a good fit, and, if you become a client, to provide the services you requested. We do not sell sensitive personal information, and we do not use it for advertising or marketing profiles.

3. How We Use Your Information

We use personal information to:

  • Respond to your questions and schedule consultations
  • Evaluate whether mediation, coaching, consulting, or another service is appropriate for your situation
  • Provide, manage, and improve our services, including intake, scheduling, and session delivery
  • Send service-related communications such as appointment confirmations and reminders
  • Send updates about our services only where you have asked to receive them
  • Operate, secure, and improve the Site and understand how it is used
  • Comply with legal obligations and protect our rights

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

4. How We Share Information

We share personal information only as needed to run our practice and the Site:

  • Service providers. Trusted vendors that help us operate, such as website hosting, form and email delivery, scheduling, secure document storage, and video conferencing through Zoom. These providers may use your information only to perform services for us.
  • Professionals you ask us to work with. If you ask us to refer you to, or coordinate with, an attorney, therapist, financial advisor, or other professional, we share only what is needed and only with your permission.
  • Legal and safety reasons. We may disclose information if required by law, court order, or legal process, or where we reasonably believe disclosure is necessary to prevent imminent harm or to meet a mandated reporting obligation.
  • Business transfers. If our business is sold or reorganized, information may transfer to the new owner, who must honor this policy.

Information shared during an actual mediation is also governed by the confidentiality terms of the mediation agreement you sign and by California’s mediation confidentiality laws (see Section 7).

5. Cookies and Analytics

The Site may use cookies and similar technologies to keep the Site working, remember preferences, and understand traffic. We may use analytics tools to see how visitors use the Site in aggregate. You can control cookies through your browser settings, including blocking or deleting them, though some parts of the Site may not work as intended.

Do Not Track and Global Privacy Control. Some browsers send “Do Not Track” or Global Privacy Control signals. We treat Global Privacy Control signals as a request to opt out of the sale or sharing of personal information. Because we do not sell or share personal information for advertising, our practices stay the same regardless of these signals.

6. Your Privacy Choices and California Rights

If you are a California resident, you may have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), to the extent it applies to us:

  • Right to know what personal information we collect, use, and disclose
  • Right to access a copy of your personal information
  • Right to correct inaccurate personal information
  • Right to delete personal information we hold about you, subject to legal exceptions
  • Right to opt out of the sale or sharing of personal information (we do not sell or share it)
  • Right to limit the use of sensitive personal information (we use it only to provide the services you request)
  • Right to non-discrimination for exercising your rights

To exercise a right, email us at nicole.oliva8@gmail.com with “Privacy Request” in the subject line. We may need to verify your identity before acting on a request. You may use an authorized agent, and we may ask for proof of their authority. We will respond within the time required by law.

California’s “Shine the Light” law also lets California residents ask about disclosure of personal information to third parties for their direct marketing. We do not disclose personal information for third-party direct marketing.

7. Confidentiality of Mediation and Coaching Sessions

Your privacy as a client is also protected by confidentiality rules that go beyond this Site policy:

  • Communications made during a mediation are generally protected by California’s mediation confidentiality statutes (California Evidence Code sections 1115 to 1128) and by the written agreement to mediate that participants sign before sessions begin.
  • Confidentiality has limits. We may be required or permitted to disclose information in situations such as suspected child abuse, elder or dependent adult abuse, an imminent threat of serious harm to yourself or others, or a valid court order. We explain these limits before mediation begins.

This website policy does not replace or change the terms of your mediation agreement.

8. Data Retention

We keep personal information only as long as needed for the purposes described above, including to meet legal, accounting, and record-keeping obligations. Inquiry information from people who do not become clients is deleted or de-identified after 24 months. Client files are retained for seven years after an engagement ends and then securely destroyed, unless a longer period is required by law.

9. Data Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, including access-limited tools for client documents. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a data breach affecting your information, we will notify you as required by law.

10. Children and Minors

The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Site. If you believe a child has provided us information, contact us and we will delete it.

Some of our services involve teens and young adults. Participation by anyone under 18 requires the involvement and written consent of a parent or legal guardian, and inquiries about those services should be made by the parent or guardian.

11. Communications

If you give us your phone number or email address, we may contact you to respond to your inquiry or to coordinate appointments. We do not send marketing text messages without your prior written consent, and you can opt out of any marketing email by using the unsubscribe link or by contacting us.

12. Third-Party Links

The Site may link to other websites. We do not control and are not responsible for the privacy practices of those sites. Please review their policies.

13. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last Updated” date above shows when it last changed. Material changes will be posted on this page, and your continued use of the Site means you accept the updated policy.
