Terms of Use

Effective Date: October 20, 2026 Last Updated: October 20, 2026

Welcome to Common Ground Mediation. These Terms of Use (“Terms”) govern your use of https://findcommongroundmediation.com (the “Site”), operated by Common Ground Mediation, LLC (“Common Ground,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. What the Site Is

The Site provides general information about the mediation, coaching, facilitation, workshop, and consulting services offered by Nicole Oliva and Common Ground Mediation in North County San Diego, California, and lets you request a consultation or contact us.

2. No Legal, Therapeutic, Medical, or Financial Advice

Content on the Site is for general informational purposes only.

  • Not legal advice. Nothing on the Site is legal advice, and nothing creates an attorney-client relationship. Nicole Oliva acts solely as a neutral mediator or facilitator and does not represent any party. Laws change and vary by situation, so please consult a licensed attorney about your specific legal rights and options.
  • Not therapy or counseling. Our services are not psychotherapy, counseling, or medical care, and our coaching and communication services are not a substitute for licensed mental health treatment. If you need clinical support, please contact a licensed professional.
  • Not financial, tax, or valuation advice. We do not provide financial, tax, or appraisal advice.

Descriptions of laws on the Site are general summaries, may not reflect the latest changes, and may not apply to your situation.

3. No Mediator-Client Relationship Through the Site

Visiting the Site, submitting a form, emailing us, or attending a free consultation does not by itself create a mediation, coaching, or consulting engagement. An engagement begins only when you and Common Ground both sign a written agreement describing the services, fees, confidentiality terms, and the roles of everyone involved.

Because the Site and initial communications may not be fully confidential, please share only the basic information needed to schedule a consultation.

4. Not for Emergencies

The Site and our contact forms are not monitored around the clock and are not for emergencies. If you or someone else is in immediate danger, call 911. If you are thinking about suicide or are in emotional crisis, call or text 988 (Suicide & Crisis Lifeline). If you are experiencing domestic violence, contact the National Domestic Violence Hotline at 1-800-799-7233 or local authorities. Mediation is not appropriate where there is abuse, coercive control, or active safety concerns.

5. Confidentiality and Its Limits

Communications made in the course of an actual mediation are generally protected under California’s mediation confidentiality laws (California Evidence Code sections 1115 to 1128) and the written agreement to mediate you sign. These protections have limits. Information may need to be disclosed in situations such as suspected child abuse, elder or dependent adult abuse, an imminent threat of serious harm, or as required by court order or law. We explain these limits before any mediation begins.

Information you submit through the Site is handled as described in our Privacy Policy.

6. Free Consultations

Initial consultations are offered at no charge and without obligation. A consultation is a conversation to help you understand your options and decide whether our services fit your needs. It is not a mediation session, and we do not guarantee that we can or will accept any particular matter. We may decline or end an engagement if mediation is not appropriate, including because of safety concerns, a conflict of interest, or a party’s unwillingness to participate in good faith.

7. Services, Fees, and Outcomes

Descriptions of services, packages, and pricing on the Site are general and may change. Pricing is quoted individually and confirmed in writing before an engagement begins. Statements about cost or timing compared with court or other processes are general observations, not promises about your case.

Mediation is voluntary. We do not guarantee any outcome, settlement, agreement, or result. Agreements reached in mediation are not automatically legally binding or enforceable. Where a legally binding or court-filed document is needed, you should consult an attorney. Common Ground may coordinate with, or refer you to, other professionals, but does not endorse or guarantee their services and is not responsible for their work or fees.

8. Testimonials

Testimonials on the Site reflect the individual experiences of the people who gave them. They are not guarantees, and your results may differ based on your circumstances.

9. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Submit false or misleading information, or another person’s information without their permission
  • Attempt to gain unauthorized access to the Site, its servers, or other users’ information
  • Introduce viruses, scrape the Site, or otherwise interfere with its operation or security
  • Use the Site to harass, threaten, or harm anyone, or to gather information for use against another party in a dispute

We may restrict or block access to the Site if we believe these rules are violated.

10. Intellectual Property

The Site and its content, including text, graphics, logos, layout, and design, are owned by or licensed to Common Ground and protected by copyright, trademark, and other laws. You may view and print content for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, or create derivative works from the Site’s content without our written permission.

11. Third-Party Links and Tools

The Site may link to or integrate third-party services such as scheduling tools, video conferencing, or document portals. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is subject to their own terms and privacy policies.

12. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, Common Ground, Nicole Oliva, and our contractors and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Site or reliance on its content. Our total liability for any claim relating to the Site will not exceed the amount you paid to Common Ground in the twelve months before the claim arose, or one hundred dollars ($100) if you paid nothing. Nothing in these Terms limits liability that cannot be limited under applicable law. Liability for professional services is governed by the written agreement for those services.

14. Indemnification

You agree to indemnify and hold harmless Common Ground and its owners, contractors, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute relating to the Site or these Terms will be brought in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.

16. Changes to the Site and These Terms

We may change the Site, its content, or these Terms at any time. Updated Terms take effect when posted, and the “Last Updated” date will change. Your continued use of the Site means you accept the updated Terms.

17. Severability and Entire Agreement

If any part of these Terms is found unenforceable, the remaining parts stay in effect. These Terms and the Privacy Policy are the entire agreement between you and Common Ground regarding the Site, and are separate from any written agreement for services.
