This is typically provided through the county's Family Court Services at no additional cost. Private mediation with Common Ground is a separate, optional process and does not replace that court-connected requirement if your case is already in litigation.
What's the difference between Common Ground's mediation and Family Court Services mediation?
Family Court Services mediators are court employees, and in counties like San Diego that operate as a "recommending county," they may submit a written recommendation to the judge if parents don't reach agreement. Nicole is a private, independent mediator and does not have the authority to submit recommendations to the court. Private mediation can be used before, during, or alongside court-connected mediation, but it doesn't fulfill the court's mediation requirement on its own.
What if we're extremely high-conflict and can't be in the same room?
Nicole can conduct shuttle mediation, meeting with each parent separately and relaying information between you, so the process can still move forward without requiring joint sessions.
What if there's a history of domestic violence in our relationship?
Mediation may not be appropriate in situations involving domestic violence or coercive control. Nicole will discuss this honestly during your consultation, and California law also has specific protocols for how court-connected mediation handles domestic violence cases.
Can mediation fully resolve our custody dispute, or just parts of it?
Both are possible. Some parents reach a full agreement through mediation; others resolve most issues and leave a narrower dispute for the court to decide, which still reduces the time and cost of litigation.
